Exclusive Resell ("Platform", "App", "we", "our", or "us") is an online marketplace that enables users in India to list, discover, buy, and sell pre-owned, used, and second-hand products in good working condition
Our goal is to provide a safer, transparent, and user-friendly platform that connects buyers and sellers while reducing fraud through account verification, listing moderation, and secure communication.
Exclusive Resell only facilitates connections between users and does not own, purchase, inspect, store, or sell any products listed on the Platform.
By creating an account, accessing, or using Exclusive Resell, you agree to be legally bound by these Terms & Conditions.
Overview of the App
Exclusive Resell is an India-based online marketplace where registered users can:
- List eligible pre-owned products for resale.
- Browse and discover products listed by other users.
- Express interest in purchasing products.
- Submit purchase offers using digital Chips.
- Communicate with other users only after the required platform conditions have been met.
- Complete transactions directly with one another.
Exclusive Resell acts solely as a technology platform and is not a buyer, seller, reseller, retailer, auctioneer, or logistics provider.
Eligibility for Users
To use Exclusive Resell, you must:
- Be at least 18 years of age.
- Be legally capable of entering into binding contracts under Indian law.
- Reside in India.
- Register using accurate and truthful information.
- Maintain only one personal account unless otherwise approved by the Platform.
We reserve the right to refuse registration or terminate accounts that violate these Terms.
Account Registration
To access platform features, users must create an account.
During registration, users may be required to provide:- Full name
- Mobile number
- Email address
- Government-issued identification (if requested)
- Selfie verification
- Other verification details as required
Users are responsible for:
- Keeping login credentials secure.
- Maintaining accurate profile information.
- Immediately reporting unauthorized account access.
Users are fully responsible for all activities performed through their accounts.
Listing Products for Resell
Users may list only products that:
- They legally own.
- Are genuine and authentic.
- Are in working or accurately described condition.
- Are permitted under these Terms.
Each listing must include:
- Accurate title
- Honest description
- Actual product photographs
- Correct condition
- Fair asking price
- Any known defects or damages
Exclusive Resell reserves the right to review, edit, reject, suspend, or remove any listing without prior notice.
Product Pricing and Payment
Sellers are solely responsible for deciding the selling price of their products.
Exclusive Resell does not:- Determine product prices.
- Guarantee any sale.
- Negotiate prices between users.
Payments for products are made directly between buyers and sellers using mutually agreed payment methods.
Exclusive Resell is not responsible for:
- Payment failures
- Payment disputes
- Fraudulent payments
- Chargebacks
- Delayed payments
Buying Products
Buyers may:
- Purchase a product at the listed price by expressing Interest.
- Submit a custom Offer at a different price.
Both actions require the use of one (1) Chip.
A buyer is responsible for reviewing product details before expressing Interest or making an Offer.
Submitting an Interest or Offer does not guarantee that the seller will complete the transaction.Shipping & Delivery
Shipping, pickup, packaging, courier selection, delivery timelines, shipping charges, insurance, and product handover are entirely the responsibility of the buyer and seller.
Exclusive Resell:- Does not ship products.
- Does not store products.
- Does not inspect products before delivery.
- Does not guarantee delivery timelines.
Users are encouraged to verify products before completing payment whenever possible.
Prohibited Activities
Users must not:
- Sell counterfeit products.
- Sell stolen goods.
- Post misleading information.
- Upload fake photographs.
- Misrepresent product condition.
- Create fake accounts.
- Circumvent platform fees.
- Harass or threaten other users.
- Upload viruses or malicious software.
- Interfere with platform operations.
- Violate any applicable law.
Violation may result in immediate account suspension or permanent termination.
Commission and Fees
Exclusive Resell may charge certain fees, including but not limited to:
- Chip purchases
- Platform fees
- Promotional services
- Premium features
- Future subscription plans
Applicable charges will always be displayed before payment.
All payments made through the Platform are subject to these Terms.User Conduct & Responsibilities
Users agree to:
- Communicate respectfully.
- Provide truthful information.
- Honor agreed transactions.
- Keep account information secure.
- Comply with applicable laws.
Users are solely responsible for the products they list, purchase, sell, or exchange.
Privacy and Data Protection
Exclusive Resell values user privacy.
By using the Platform, users consent to the collection, storage, processing, and use of information in accordance with our Privacy Policy.
Verification documents are collected solely for identity verification, fraud prevention, legal compliance, and platform security.Limitation of Liability
Exclusive Resell only provides a digital marketplace.
We are not responsible for:- Product quality
- Product authenticity
- Product condition
- Product safety
- Buyer or seller conduct
- Shipping losses
- Delivery delays
- Payment disputes
- Financial losses
- Personal damages arising from user transactions
Users transact entirely at their own risk.
Indemnification
Users agree to indemnify and hold harmless Exclusive Resell, its owners, employees, affiliates, and partners from any claims, liabilities, losses, damages, legal expenses, or disputes arising from:
- User listings
- User transactions
- Violation of these Terms
- Violation of applicable laws
- Intellectual property infringement
Termination and Suspension
Exclusive Resell may suspend or permanently terminate any account without prior notice if users:
- Violate these Terms.
- Engage in fraud.
- Misuse the Platform.
- Submit false information.
- Abuse other users.
- Violate applicable laws.
Termination does not remove any legal obligations already incurred.
Where an account is suspended or deactivated by Exclusive Resell for violations of these Terms, the account may remain inaccessible until the Platform determines, at its sole discretion, that reactivation is appropriate, if at all.Governing Law and Dispute Resolution
These Terms shall be governed by the laws of India.
Any disputes arising from the use of Exclusive Resell shall first be attempted to be resolved amicably.
If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts in Belagavi, Karnataka, India.- These Terms shall be governed by and construed in accordance with the laws of India.
- Any disputes arising from or in connection with these Terms shall be resolved through informal negotiations. If resolution cannot be reached, the dispute will be submitted to the exclusive jurisdiction of the courts in [City, State, India].
Changes to the Terms and Conditions
Exclusive Resell reserves the right to modify these Terms at any time.
Updated Terms become effective immediately upon publication within the Platform.
Continued use of the Platform after updates constitutes acceptance of the revised Terms.
Offer-Making Chips Refund Policy:
A Chip is a digital token purchased using real money that enables a buyer to either:
- Express Interest in purchasing a product at the seller's listed price; or
- Submit an Offer to purchase the product at a different price.
Each Interest or Offer consumes one (1) Chip.
Once a Chip has been used, it is considered consumed and cannot be refunded, reversed, transferred, or restored, regardless of whether:
- The seller accepts or rejects the Interest or Offer.
- The seller does not respond.
- The product is sold to another buyer.
- The listing is removed after the Interest or Offer is submitted.
- The buyer decides not to proceed with the purchase.
Unused purchased Chips may remain in the user‘s account subject to future platform policies unless otherwise specified.
Platform Fee Refund Policy
Certain transactions on Exclusive Resell may require payment of a Platform Fee.
Unless required by applicable law, Platform Fees are non-refundable once the related service has been successfully provided.
Refunds will only be considered in circumstances such as:
- Duplicate payment due to a technical error.
- Incorrect amount charged because of a verified system malfunction.
- Payment processed successfully but the requested platform service could not be delivered due to an error attributable to Exclusive Resell.
Refund requests must be submitted within the timeframe specified by the Platform and may require supporting information for verification.
Exclusive Resell reserves the right to approve or reject refund requests after review.
Products That Cannot Be Listed
The following products are prohibited from being listed or sold on Exclusive Resell:
- Illegal products
- Stolen goods
- Counterfeit or replica items
- Weapons, firearms, ammunition, explosives
- Drugs, narcotics, or controlled substances
- Alcohol and tobacco products
- Prescription medicines and medical devices requiring authorization
- Hazardous chemicals
- Human organs or body parts
- Live animals
- Adult or explicit content
- Gambling-related products
- Government documents or identity cards
- Currency or counterfeit money
- Digital accounts or hacked software
- Products that infringe intellectual property rights
- Recalled or unsafe products
- Any item prohibited under Indian law
Exclusive Resell reserves the right to remove any listing that violates these restrictions.
